User represents to the Bay View Neighborhood Association (“BVNA”) that it is the sole owner of any content submitted to this website, and that its submission is free of any restrictions and limitations on its use, reproduction, or publication.
User hereby grants to the BVNA a non-exclusive, perpetual and worldwide right and license to use, reproduce, adapt, modify and display any content it submits.
User agrees that it will not submit any vulgar, obscene, unlawful, or otherwise objectionable content to this website, and the BVNA reserves the right to deny submissions for any reason. Notwithstanding this prohibition on objectionable content, User acknowledges that its use of this website may expose it to such content.
User will indemnify, defend, and hold harmless the BVNA and its directors, officers, members, employees, subsidiaries, agents, successors and assigns from and against any and all claims, expenses, losses, damages, costs, liabilities and judgments, including without limitation reasonable attorneys’ fees and expenses, arising out of or relating to any claim, demand, or action by a third party arising out of any breach of User’s responsibilities or obligations, representations or warranties under these Terms and Conditions.
These Terms and Conditions represent the entire agreement between User and the BVNA and shall be governed by, and interpreted under, the internal laws of the State of Wisconsin (without regard to conflict of law rules) and the United States of America. The parties further agree that any action, suit in equity, arbitration proceeding or judicial proceeding for the enforcement of this Agreement or any provision hereof shall be instituted in the State of Wisconsin, USA and specifically in the Circuit Court of Milwaukee County, except that any judgment obtained in any such court may be enforced in any other court. Any provision of these Terms and Conditions prohibited by applicable law or by court decree shall be ineffective to the extent of such prohibition without invalidating or affecting the remaining provisions of this these Terms and Conditions.
